Please note: The following information is for documents that will be notarized by your notary or for documents that are already notarized. Each USA state has their own particular notarial wording that must be placed on a notarized document. The notarization is more than the notary public writing a date, signing their name & placing their stamp on the document.
If your document is notarized, the Notarial Wording is a very important part of your document, Do not allow the notary public to just sign their signature, date it and place their notary stamp on the document. This is very wrong & there is a good chance your document will be rejected because it does not meet the minimum Statutory requirements of a properly notarized document. In addition to the proper Notarial Wording shown below, the notary public must also sign their signature by hand in ink, exactly as their name is indicated on the notary’s commission card that is on file at the County Clerks Office.
If your document is ever subjected to a legal action, your case could be lost because of a improperly notarize document. Also, documents submitted for authentication will be rejected by most County Clerks if it does not include the notarial wording. In addition, a notary public who engages in sloppy notary work can subject themselves to potential disciplinary action and other liability, this why as a Notary Public it's a good reason why you should have Professional Insurance or Error & Omission Insurance
The document must have:
(Sometime you will see the word "SEAL" on your document, it is actually referring to the notary's stamp . This is a term used in the old days when the SEAL was make of wax. The notary embosser is the raised seal, in New York State it has NO value other than for decoration. However, in some countries the rasised seal maybe a very important part of the document
If any of the above items are not on your document YOU must tell the notary you need them added. The above information is in addition to what you may find on a notary's stamp . So, do not confuse the above with the information that is on a notary public stamp.
Because the law does not allow a notary public to give legal advice, the notary is not allow to tell you which one to use. The notary public can explain the difference between the ACKNOWLEDGEMENT & the JURAT but it's up to YOU to choose which one to need. The notarial wording should be added on the signature page, However if you don't have enough room on the signature page a separate page called a loose certificate can be attached to the original document. Also note the SS found in the venue area means scilicet (to wit, namely, that is to say) it does not mean you have to place your Social Security number there, it is only there to represent the formality of legal documents and can be omitted.
Since the notary's signature is compared to the signature on their notary commission card when they renew their commission. Please make sure the notary does not scribble their signature unless that is how they wrote it on their notary commission card when they renew their commission.
If you do not have this information on your document it will cause a delay in processing your document because there is a good chance your document will be rejected when it is review by the County Clerk. You will then have to resubmit your document with the correct information
